Accordingly, notwithstanding the right and license granted to us in these Terms, you understand and agree that we have not become and are not a publisher of such User Content and are merely functioning as an intermediary to enable you to provide and display User Content. Moreover, we assume no responsibility for the deletion of or failure to store any User Content. We recommend that you do not post, display, or transmit any User Content containing confidential, personal, or sensitive information, all of which you post, display, or transmit at your own risk.

We always appreciate your feedback or other suggestions about our website, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

Sharing Your Content and Information

All products are available to order on our autoship program. When customers subscribe to the autoship program, we will conveniently charge their credit card for their order at a discount at the time their order is set to renew. If you order a PhysioTru, we will automatically ship you a new supply of the product or products you have ordered determined by the amount that you have ordered, and continuing until you cancel. An example would be if you ordered one 30-day supply it will renew 30 days from when your initial order was placed. If you ordered a 3 month supply it would renew 3 months from your initial order date. The credit card you are using today will be billed the lowest available price for that product or products when your order is shipped, but shipping will be FREE. You may log into your customer account or call our customer service department toll-free at 1-888-332-9372 between the hours of 8am - 9pm EST Mon-Fri to cancel future shipments, customize the timing of your shipments, or change the credit card used for billing.

Class Action Waiver

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.

The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.

If any clause within this Provision (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that clause will be severed from this Provision, and the remainder of this Provision will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable and the dispute will be decided by a court.

GOVERNING LAW. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Changes to These Terms

We reserve the right, in our sole discretion, to modify these Terms at any time. If we decide to change these Terms, we will post those changes on our Site and update the "Effective Date" at the top of these Terms. We encourage you to periodically review these Terms. Your continued use of this Site after any changes have been posted constitutes your agreement to the changes.
